11. The McCanns said Madeleine and younger brother S*** were crying on their own the night before she was reported missing. Yet they left all three children on their own again the very next night.

Verdict - True.  The McCanns volunteered this information immediately.

Source - Police files - note that this was leaked to the media and appeared in many articles long before the police files became available.

Summary of Verifiable Facts

  1. The McCanns volunteered this information immediately.
  2. Whilst still under the constraints of judicial secrecy, their police statements regarding this were later leaked to the media.
  3. They explained that Madeleine did not seem concerned when she asked the question and that she dropped the subject when they asked her about it.
  4. They explained that it was only with hindsight that they realised it might be significant.

Gerry McCanns Statements

Gerry's statement on 4th May 2007 (Note that this is a police summary of what he said)

Quote:

Between April 28th, the day of arrival, and the time when MADELEINE disappeared, the deponent reports having noticed nothing unusual, except that on the morning of May 3rd, MADELEINE asked her father, GERALD, why he had not come into her bedroom when the twins were crying. The deponent had heard nothing and therefore had not gone into the room, yet he thought his daughter’s comment was strange, even because it was the first time that she made it.

Gerry McCann's statement on 10th May 2007 (Note that this is a police summary of what he said)

Quote:

On the day Madeleine disappeared, Thursday, 03/05/07, they woke at the same time, between 7.30am and 8.00am. When they were having breakfast, Madeleine looked at her mother and asked her "why did you not come last night when Sean and I were crying?". He found this comment very strange, since Madeleine had never had this type of conversation and on the previous night, they had maintained the same checking system on the children and detected nothing abnormal. When they questioned her regarding this comment, she dismissed it without any explanation

Kate McCann's statements

Kate's statement on 4th May 2007 (note that this is a police summary of what she said)

Quote:

She reports only one episode where, on the morning of Thursday the 3rd, Madeleine asked the witness why she had not come to look in the bedroom when the twins were crying. The witness states that she had heard nothing and had therefore not gone into the bedroom, nevertheless she found her daughter’s comment strange because it was the first time she had made it.

Kate's statement on 6th September, 2007  (note that this is a police summary of what she said)

Quote:

Regarding the fact that on the next morning, Thursday, during breakfast, Madeleine said to both of them that she had been crying and that nobody had come to her room, she presumes that this crying must have been before she and Gerry returned to the apartment. When she asked Madeleine about this however, the child gave no importance to the matter.

Kate McCann was not asked about the incident at her arguida interview.

The Leaks

Despite the judicial secrecy which is in place to protect the integrity of police investigations and subsequent trials, this story was leaked to the media.  The McCann's spokesman responded with this statement:-

From Sky News on 11th April 2008

Quote:

Kate and Gerry McCann have hit back after the leak of a police interview revealed that their daughter Madeleine had asked why she had been left to cry in the night.

The interview transcript was obtained by Spanish television journalist Nacho Abad, who claimed he could not reveal his source.  But Clarence Mitchell, spokesman for the McCanns, said the statement would have come from within the Portuguese police and launched a blistering attack on their attempts to "smear" the McCanns.  "It is a shameless, brazen and very cack-handed," he told Sky News.

"The Portuguese government must now get a grip on whatever element it is within the Portuguese police that is responsible for these leaks and smears."

"They have continued since last summer and when the officer in charge of the inquiry, the man brought in to sort it out, is visiting here, off they go again.

"We know what they're up to, it is ridiculous and must stop," he said.

Mr Mitchell added that the release of the confidential police documents was a "blatant and timed smear campaign", designed to coincide with the McCann's efforts to promote a child alert system in Brussels.

The McCanns have also responded to questioning about the crying incident in TV interviews.

From "Madeleine - One Year On" - ITV on 30th April 2008

Kate McCann speaks emotionally about her regrets and the benefit of hindsight:-

Quote:-

We obviously told the police because we thought 'does this indicate that someone's been round the night before?' and that's what's woken her up; which is significant, you know... you know, I've... you know, I've persecuted myself over and over again about that statement because you think 'Why didn't I, kind of, just hold her and say 'What d'you mean? What d'you mean?,' you know, 'What d'you mean you woke up?,' you know, and, kind of... but, you don't think that. I mean, it's easy saying that after what's happened...

...

I do go back and it does upset you and you think: 'Ohh, Why didn't I say: 'Why did you cry? Why did you cry?, you know, and 'Why didn't we go the Millennium?' and blah, blah, blah', you know, and then, as Gerry said, the... the guilt you feel for not being there and giving someone that opportunity, you know, but then I just have to, kind of, reel myself in and think, you know, I know how much I love Madeleine and I have no doubt that Madeleine knows how much, you know, I love her and I think... I mean, I know that, and I've just got to think, regardless of what all those people say out there; you know, those bloggers and people on the forums who obviously get some kind of kick out of being nasty. I know that, and I know Madeleine knows that, and I've just got to, kind of, keep hold of that, really...

Gerry McCann from the same interview:-

Quote:

But, I mean, the worst thing is, that you can't change any of that and it doesn't help find her and I think we've actually... despite, you know, our own guilt, we've tried to focus on what we can change
